Buying property in India while living in Dubai or elsewhere in the UAE can feel more complicated than it needs to be — mostly because the process isn't always explained clearly. Step 1: Confirm Your NRI Status and Eligibility
Under FEMA (Foreign Exchange Management Act) regulations, NRIs and OCIs (Overseas Citizens of India) are permitted to purchase residential and commercial property in India without special permission, with the exception of agricultural land, plantation property, and farmhouses. If you hold an Indian passport and live abroad, or hold an OCI card, you are generally eligible to buy a home in Ahmedabad the same way a resident Indian would.
Step 2: Gather the Right Documents
Before you begin, keep digital and physical copies of the following ready:
- Valid passport (and OCI/PIO card, if applicable)
- PAN card (mandatory for property transactions in India)
- Overseas address proof (utility bill, Emirates ID, or bank statement)
- Recent passport-size photographs
- NRE/NRO bank account details for the payment trail
If you don't yet have a PAN card, you can apply for one from Dubai through the NSDL or UTIITSL online portals — it typically takes a few weeks to arrive.
Step 3: Decide How You'll Pay
Payments for property in India must be made through banking channels — not cash — using either an NRE (Non-Resident External), NRO (Non-Resident Ordinary), or FCNR (Foreign Currency Non-Resident) account. Most developers, including our team, will guide you on the correct account type based on how you plan to eventually manage rental income or resale proceeds.
Step 4: Use a Power of Attorney If You Can't Be Present
Many NRI buyers cannot travel to Ahmedabad for every stage of the transaction. In such cases, a registered Power of Attorney (PoA) — executed at the Indian Consulate in Dubai and subsequently adjudicated in India — allows a trusted family member or representative to sign documents, complete registration, and handle possession formalities on your behalf.
A PoA executed and attested correctly at the consulate saves multiple trips back to India — it's one of the most useful tools available to NRI buyers.
Step 5: Verify the Project Thoroughly
Distance makes due diligence more important, not less. Before booking, verify:
- RERA registration with the Gujarat Real Estate Regulatory Authority — check the project's registration number on the official RERA website.
- Title and land records — ask for the 7/12 extract or equivalent land ownership document and the approved building plan.
- Builder reputation — look at previously delivered projects, not just marketing brochures for the current one.
- Payment schedule — ensure it's tied to construction milestones, not arbitrary dates.
Step 6: Complete Registration and Stamp Duty
Property registration in Gujarat involves paying stamp duty and registration fees, calculated on the property's market or agreement value, whichever is higher. If you're unable to be present in person, your PoA holder can complete this step at the local Sub-Registrar's office on your behalf.
Step 7: Understand Tax Implications
Rental income earned from Indian property is taxable in India, and NRIs are generally required to file an Indian income tax return if they earn rental income or capital gains here. Many NRIs also need to check the Double Taxation Avoidance Agreement (DTAA) between India and the UAE to understand how this interacts with any tax obligations in their country of residence. Step 8: Plan for Repatriation, If Relevant
If you eventually plan to sell the property and move the proceeds back to Dubai, RBI rules allow repatriation up to certain limits, subject to conditions and proper documentation of the original investment. Keeping clean records of your NRE/NRO transactions from day one makes this process significantly smoother years down the line.
